DECLARATION OF RESTRICTIONS

July 1, 1946, there was filed in the office of the Recorder's office of Black Hawk County, recorded in Book 48 of Miscellaneous Records page 325, a Declaration of Restrictions, which recites as follows:

Use of Land:  None of said lots may be improved, used or occupied for other than single, private residence purposes, and no double house, duplex, flat or apartment house, though intended for residence purposes, may be erected or maintained thereon.  Not more than one house shall be built on any one lot, but this shall not prevent the building of a single residence on more than one lot.  No lot shall be sold to, rented to, leased by or occupied by any person other than of the Caucasian race; but this Covenant shall not prevent occupancy by domestic servants who do not belong to the Caucasian race and who are domiciled with a lot owner or tenant belonging to the Caucasian race.

No trailer, basement, tent, shack, garage, barn or other out building on any lot in such addition shall at any time be used as a residence either permanently or temporarily, nor shall any structure of a temporary character be used as a residence.  No old or previously used building shall be moved on to any of the lots in said Addition.

Set back of residences: No part of any residence except as hereinafter provided may be erected or maintained on any of said lots nearer to the front street or side street than is the front building line or the side building line shown on said plat for the lot or lots on which such residence may be erected.

THIS IS AN EXAMPLE OF A RESTRICTIVE COVENANT AS THEY EXISTED IN MANY PLATS FOR THE SUBDIVISION AND SALE OF RESIDENTIAL REAL ESTATE IN THE CITY OF WATERLOO AND IN OTHER COMMUNITIES THROUGHOUT THE UNITED STATES.
